Terms and Conditions for Learning Quests™

Welcome to Learning Quests™, a program created by Learning Re-Engineered (a DBA of AKology LLC), based in Virginia, USA. By using this website and any products or services I provide, you agree to the following Terms and Conditions.

Please read these terms carefully. If you do not agree, do not use the site.

1. Who Can Use Learning Quests™

Learning Quests™ is designed for families, homeschoolers, and educators. While children may use many of the interactive quests and activities, only parents, guardians, or educators (“Responsible Adults”) may create accounts or make purchases.

If you’re under 18, a parent or guardian must register and manage the account on your behalf. You may not create your own account.

2. Parent & Guardian Responsibility

As a Responsible Adult, you agree to:
▪ Create and manage accounts for your children or students
▪ Monitor your child’s use of the site and activities
▪ Avoid sharing your child’s personal information (name, address, school, etc.)
▪ Use usernames and submissions that protect your child’s identity
▪ Request edits or deletions of any content you believe needs to be removed

You understand that I am not liable for content made public at your discretion. I encourage adults to guide children in using the platform safely and respectfully.

3. Memberships and Subscriptions

Learning Quests™ offers both free and paid membership tiers. Subscriptions may include digital downloads, printable guides, access to games, and live online events.

Your membership begins once payment is processed and will renew automatically unless you cancel before your next billing date.

All payments are final. I do not offer refunds for unused time, accidental purchases, or cancellations partway through a billing cycle.

To cancel, you may email me at support@learning-quests.com or log in to your account settings (if available) and select “Cancel Membership.” Cancellations take effect at the end of the current billing period.

4. Product Purchases and Refunds

You may purchase individual products in addition to your membership. Please note:

▪ All sales are final
▪ Digital downloads are non-refundable
▪ Physical products may be replaced if they arrive damaged or defective. Contact me within 7 days of delivery with photos of the issue.

If you’re unsure whether a product is right for you, please read the full description or contact me before purchasing.

5. Intellectual Property

All Learning Quests™ content including quests, graphics, videos, downloads, worksheets, and written materials is the intellectual property of AKology LLC unless otherwise stated. You may not copy, sell, or share any material without my written permission.

You retain rights to original work submitted by your child. However, by sharing it on the platform, you grant me a non-exclusive license to display or promote it if it has been made public.

6. Community Conduct

Learning Quests™ is a family-first platform. You agree not to share or submit content that is:
▪ Inappropriate, offensive, or hateful
▪ In violation of copyright or privacy laws
▪ Personally identifying about a child or user
▪ Promotional or spam in nature

I reserve the right to remove content or suspend accounts that violate these standards.

7. Site Availability

While I aim to provide a secure and stable platform, there may be occasional downtime due to maintenance or technical issues. I am not responsible for any loss resulting from temporary site unavailability.

8. Account Security

You are responsible for keeping your login information private. If you suspect unauthorized use of your account, contact me immediately. I am not responsible for misuse due to shared or insecure passwords.

9. External Links

This site may link to third-party services like Koala Go, Stripe, PayPal, or social media. I am not responsible for their content or policies. Please review their terms and privacy practices separately.

10. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia and the United States. Any disputes will follow U.S. legal processes.

11. Disclaimer of Warranties

All services and content are provided “as is” and “as available.” I do not guarantee the site will be error-free or always available. I disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the fullest extent permitted by law:
▪ I am not liable for direct, indirect, incidental, special, or consequential damages
▪ My total liability is capped at the amount you paid in the past 12 months

Exceptions: I do not limit liability for:
▪ Gross negligence or willful misconduct
▪ Personal injury or property damage caused by negligence
▪ Fraud or deceptive practices under Virginia’s Consumer Protection Act
▪ Any issue where liability cannot be waived under applicable law

13. Indemnification

You agree to defend and hold me harmless from any claims, costs, or damages that result from your use of the site or violation of these terms.

14. Termination

I reserve the right to suspend or terminate your access at any time if I believe you’ve violated these terms or harmed other users. Terminated accounts lose all access to services, and no refunds will be issued.

15. Dispute Resolution

For U.S. users: All disputes will be resolved by binding arbitration through the American Arbitration Association. You agree to resolve issues individually and waive class actions.

For international users: Disputes will follow Virginia law and be handled in Virginia state or federal courts.

16. Modifications to Terms

I may update these Terms at any time. If I make material changes, I’ll post an updated version and change the “Effective Date” above. By continuing to use the site after any updates, you agree to the revised terms.
